1) Overview & Acceptance

These Terms of Service (“Terms”) govern your access to and use of IT Guy Next Door’s site, communications, and services (“Services”). By contacting us, scheduling with us, or using our Services, you agree to these Terms.

2) Scope of Services & Limitations

• We provide in-person and on-site assistance, setup, configuration guidance, and troubleshooting support focused on small-office/home-office technology.
• “We Fix It or You Don’t Pay” applies only to labor charges for issues we can reasonably reproduce and resolve during the appointment, excluding any hardware/parts, third-party fees, procurement time, travel, incidental expenses, and scenarios listed under “Guarantee Exclusions.”
• We do not provide manufacturer warranties, and we are not a service center for any brand.

3) Scheduling, Access & Safety

• You must have proper authority to grant us access to the premises, devices, and accounts you ask us to work on.
• You agree to provide a safe, hazard-free environment and to comply with all applicable laws.

4) Fees, Payment & Cancellations

• Pricing is as agreed upon at the time of appointment booking. A travel fee and other itemized expenses may apply.
• Payment is due upon completion of the appointment by cash or card.
• Cancellation fees may apply once a technician is en route.

5) “We Fix It or You Don’t Pay” — Conditions & Exclusions

• Applies to our labor only; excludes hardware failures, liquid/impact damage, physical component replacements, third-party outages, vendor/account issues, ISP problems, and situations outside our control.
• Not applicable if (a) you decline a recommended remedy; (b) the issue is intermittent or not reproducible during the appointment; (c) device or data is unbacked-up and a risk-free remedy is impossible; (d) unauthorized software, licensing, or policy constraints prevent completion; (e) further paid work is required beyond the booked scope; or (f) the work constitutes training, optimization, or general consultation rather than a discrete incident resolution.
• Data recovery attempts, complex migrations, and security incidents are expressly excluded from the guarantee.

6) Your Responsibilities

• Maintain current backups and take full responsibility for your data at all times.
• Ensure you have valid licenses for any software we are asked to install or configure.
• Provide truthful information and timely cooperation.

7) Third-Party Products & Services

• We may recommend third-party products or services solely for convenience. We neither control nor warrant third-party offerings.
• All third-party names and logos are used descriptively and remain the property of their respective owners.

8) Disclaimers of Warranties

Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9) Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost data, loss of goodwill, device issues, or business interruption, arising from or related to the Services, even if advised of the possibility of such damages. Our aggregate liability shall not exceed the amount you paid to us for the appointment giving rise to the claim.

10) Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising from your misuse of the Services, breach of these Terms, or violation of any law.

11) Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Parties agree to attempt informal resolution first; either party may pursue claims in small-claims court where allowed. Class actions and class arbitrations are waived to the extent permitted by law.

12) Changes

We may update these Terms at any time by posting the revised version on this page with a new effective date.
