You are solely responsible for your devices, networks, accounts, data, backups, passwords, licensing, and compliance at all times.

Security & Safety Practices: For your security and safety, we never ask for sensitive information such as passwords, OTPs, or sensitive personal details. Please do not share those. We do not provide remote sessions into your computer for your security. Card payments are securely handled by a card reader from our payment partner, Square, and an invoice with a detailed bill will be shared immediately for your reference. All our engineers and technicians undergo thorough background checks.

The “We Fix It or You Don’t Pay” guarantee shall not apply to (i) hardware-related services, including but not limited to diagnosis, repair, or replacement of physical components, or damage resulting from liquid exposure, impact, or other external causes; (ii) account-related issues, including but not limited to account recovery, hacked accounts, scammed accounts, or otherwise compromised accounts; (iii) circumstances beyond our reasonable control; (iv) failures or disruptions attributable to third-party services, internet service providers (ISPs), or external vendors; (v) data recovery services; (vi) intermittent, non-reproducible, or non-verifiable issues; (vii) situations in which recommended solutions or remediation steps are declined by the client; or (viii) services consisting of training, optimization, advisory, or consultation. Notwithstanding the foregoing, all travel-related expenses, on-site service fees, procurement costs, and any other incidental or miscellaneous charges shall be payable by the client irrespective of the outcome of the service. A cancellation fee shall apply in the event the service is cancelled after a Technical Support Engineer or Technician has been dispatched and is en route to the service location.

1) Overview & Acceptance

These Terms of Service (“Terms”) govern your access to and use of IT Guy Next Door’s site, communications, and services (“Services”). By contacting us, scheduling with us, or using our Services, you agree to these Terms.

2) Scope of Services & Limitations

• We provide in-person and on-site assistance, setup, configuration guidance, and troubleshooting support focused on small-office/home-office technology.
• Free pre-appointment consultation & transparent start: We begin with a complimentary phone or email discussion of your issue. Based on the information you provide, we decide whether to accept the appointment and will share an estimated price range and key fees before booking. While we aim to take on only issues where we reasonably believe we can help, not every problem can be fully resolved in every circumstance.
• We do not provide manufacturer warranties, and we are not a service center for any brand, including Microsoft; our role as an authorized Microsoft Partner relates to our experience with Microsoft technologies, not to warranty or repair authorization.

3) Scheduling, Access & Safety

• You must have proper authority to grant us access to the premises, devices, and accounts you ask us to work on.
• You agree to provide a safe, hazard-free environment and to comply with all applicable laws.
• For your security and safety, we never ask for sensitive information such as passwords, OTPs, or sensitive personal details. Please do not share those.
• We do not provide remote sessions into your computer for your security.
• All our engineers and technicians undergo thorough background checks.

4) Fees, Payment & Cancellations

• Pricing is as agreed upon at the time of appointment booking. A travel fee and other itemized expenses may apply.
• Payment is due after completion of the agreed-upon work, once we have walked you through the results. We accept cash or card. All card payments are securely handled through a card reader from our payment partner, Square, and an invoice with a detailed bill will be shared immediately for your reference.
• Cancellation fees may apply once a engineer is en route.
• No refunds will be provided once the service has been completed. By proceeding with the service, the customer acknowledges and agrees that all completed services, labor charges, diagnostic fees, on-site visit charges, and related service costs are final and non-refundable.

5) Pre-Appointment Consultation, Start Conditions & Limitations

• We aim to accept only issues where we reasonably believe we can help, but some problems cannot be fully resolved due to factors outside our control.
• If during the appointment we determine that a recommended remedy is declined, the problem is intermittent or not reproducible, device or data is unbacked-up and a risk-free remedy is impossible, software/licensing/policy constraints prevent completion, or further paid work is required beyond the originally booked scope, we will pause, explain your options, and agree on any next steps and related pricing with you before continuing.
• Data recovery attempts, complex migrations, and security incidents are inherently uncertain. We do not promise a particular outcome for these categories of work, but we will explain expected effort, risks, and limitations before you authorize us to proceed.

6) Your Responsibilities

• Maintain current backups and take full responsibility for your data at all times.
• Ensure you have valid licenses for any software we are asked to install or configure.
• Provide truthful information and timely cooperation.

7) Third-Party Products & Services

• We may recommend third-party products or services solely for convenience. We neither control nor warrant third-party offerings.
• All third-party names and logos are used descriptively and remain the property of their respective owners.

8) Disclaimers of Warranties

Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9) Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost data, loss of goodwill, device issues, or business interruption, arising from or related to the Services, even if advised of the possibility of such damages.

10) Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising from your misuse of the Services, breach of these Terms, or violation of any law.

11) Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
